Employment (Allocation of Tips) Act 2023

15th June 2024

Employment law, Newbury, Berkshire.

The previous government delayed the implementation of the Employment (Allocation of Tips) Act 2023 until 1st October 2024 (rather than 1st July 2024) and we will have to wait and see whether there are any further changes.

Employment law on the allocation of staff tips

This legislation requires:

  1. employers to pass tips on to workers;
  2. employers to have a “tipping policy” where tips are left more than occasionally;
  3. workers to have a new right to request a copy of their tipping record. This would enable them to bring a claim where they believe they are not receiving tips they should be.

Employers will also be required to have regard to a new statutory Code of Practice when distributing tips and you can see the latest draft version here: Distributing tips fairly: draft statutory code of practice - GOV.UK (www.gov.uk)
