CAFCASS stands for Children and Family Court Advisory and Support Service and they are often referred to as the Court appointed social workers, or my favourite term, “the eyes and ears of the Court that focus on the children”.
CAFCASS regularly publish their statistics on their website showing trends their work and trends in the Family Court regarding proceedings under the Children Act 1989. The latest statistics show what many of us feared, there are more families enduring litigated proceedings about their children than ever before!
At the end of August 2023 there were reportedly 50,747 children subject to CAFCASS involvement across 31,495 separate cases. In August 2023 alone there were 4,936 new cases opened by CAFCASS. It is reported this is a 4.5% increase when compared to just before the beginning of the COVID lockdowns in March 2020.
As a specialists in Family Law, who regularly appear in Court on matters pertaining to Children, the strain these numbers are placing on the system is clear to us. Whilst Court proceedings are necessary in many circumstances the importance of taking advice from a specialist family lawyer, with hands on and up to date knowledge of the issues involved, as early as possible is never clearer. The limited resources of CAFCASS mean that this level of workload is stretching their ability to safeguard and make recommendations for the best interests of the children that really need their intervention. Careful assessment of all of your options and consideration of other methods of dispute resolution are beneficial – this could be Arbitration, Mediation, Hybrid-Mediation (with lawyers) or child inclusive practices.
