Business Protection & Restrictive Covenants

Employment law, Newbury, Berkshire.

Hindsight is a wonderful thing.

Use us before you need it. Your business has confidential information, customer discount lists and marketing plans. Your employees have built relationships with your clients.

When a valued employee or team moves to a competitor, there are often sensitive and complex legal issues which you need to tackle urgently. The team:

  • may have resigned in close succession,
  • they may have removed your confidential information and
  • may be intending to approach your key clients.

Responses could include:

  • enforcing contractual obligations and restrictive covenants,
  • injunctions,
  • contempt of court proceedings, and
  • using forensic IT specialists to recover data and evidence.

This often involves working long hours and at short notice, which could be crucial when you need an injunction to prevent damage to your business.

Request a call

We have extensive experience in the fields of employment law and High Court litigation. We are well placed to advise you about the most appropriate strategy and the available courses of action, and help you seek protection or damages in the courts.

The first step is to make sure you have protected your the business with properly drafted restrictive covenants, to prevent your employees leaving and taking your clients with them. Restrictive Covenants need to be carefully drafted so that they say the right things and are not too oppressive. Badly drafted restrictive covenants are not enforceable.

A seriously worded letter often stops the employee straight away. However, sometimes we need to urgently go to court to get an injunction preventing them from competing.

Experience Counts

We have acted for:

  • Recruitment companies preventing consultants taking clients and candidates with them when setting up their new businesses
  • Multinational carpet company stopping a sales team unlawfully competing
  • A national tyre company stopping an employee stealing lists of customers and their discounts
  • A printing company ceasing documents and physical assets taken by an employee
  • Acting for two hairdressers who set up in competition with a high profile national hairdressing chain (yes, them) despite having signed restrictive covenants. Our clients were allowed to compete.

We have particular experience of these cases in law firms, recruitment businesses and media sectors.

We offer high quality employment law advice both to employers and to individuals. Understanding how both sides think provides us with a tactical advantage, and we are often referred work by other law firms.

How to choose the right Lawyer

Why Choose Fenton Elliott?

Specialists in employment and family law

We are specialists in employment and family law. We don’t do anything else. Nothing to distract our focus. No pretending we are great at everything. We just strive to excel in our one little bit of law and focus on doing it to the best of our ability every day..

We provide clear, unambiguous communication. You will not need to refer to a Latin dictionary and you will not have to struggle with long, convoluted sentences. Our style guru is Ernest Hemingway. Basically, a typical Hemingway novel is written in simple, direct, unadorned prose and that’s what we try to do..

Our individual clients come from a range of backgrounds and from across the country as well as in West Berkshire/Oxfordshire. This means we use our experience of working with IT companies for the benefit of accountants and vice versa. We bring the best bits of how some businesses work to our other clients. And we act for both employers and employees, so we know how the other side thinks, what their objectives are and how to use this for our client’s advantage. Poacher turned gamekeeper (and back again).

We are competitively priced against our peers. And because we specialise in family and employment law, we are experienced and efficient at delivering our services. This means we work quickly, which in turn keeps your costs down.

We are responsive. Some professional advisers gloat about returning your call within 24 hours. Honestly! If you need help now, 24 hours is not helpful. We will always return your call within 2 hours, usually sooner.

We don’t sit on the fence. You will actually get an answer. You will get advice tailored for your needs, not some generic waffle about best practice.

Simon is a quite brilliant commercial employment lawyer. He advises on what to do and how to do it - not on the law. He must know the law too, because he has won every case that he has taken to the tribunal for me. I would only ever use Simon as my employment lawyer.
